Drafting a contract that protects your needs is a must for any freelancer

2011-12-14

Working alone as a freelancer can be a liberating experience, but it will initially require navigating through some uncertainty. While you are independent and self-sufficient, it often leaves you solely responsible for tasks that typically fell outside of your past job descriptions. One such undertaking that creative freelancers may suddenly have to embrace is drafting a contract.

A contract is an important document that acts as a reference point for you and your client. It isn't a suggestion, it's a must. Unfortunately, freelance creatives do not have the luxury of a legal department. Therefore, when drafting your own, you must be as comprehensive and concise as possible. Over all, a contract is what holds your client accountable for the work you produce, as well as outlines exactly what role you are willing to play.

It may seem obvious, but some of the most essential information on a contract is also the most basic. Remembering to include the client's name on the document will help remove any ambiguity if they attempt to back out of the agreement later on. In addition, believing you have come to terms with fair compensation is not enough. Including the exact dollar amount is extremely important and helps prevent situations where clients dispute the terms you've agreed upon.

Along the same lines as drafting an entire section dealing with payment, include how many revisions you are willing to perform for that amount of money. Informing clients that you are no longer obligated to a task after a certain point will prevent them from requesting more of your services than you initially agreed to provide. Obviously, being helpful is important in continuing as a freelancer. However, knowing when enough is enough will benefit you in the long run.

Time frames need to be established and documented in a contract. A proper time frame will keep you motivated to finish a project. Strategic planning and time management is key - if you are contractually held to a project for too long, you can miss out on future opportunities to expand your network. The proper contract will help you focus on the project at hand while helping you keep future opportunities on your radar.

Working as a freelancer can help you accomplish all of the things you've wanted to in your career. Failing to properly protect yourself in the process can result in disheartening outcomes. While drafting contracts may not be your strong point, it's a safety blanket you won't want to leave out.
